Usage Terms and Conditions for photos of Soho House Berlin GmbH

The following usage terms and conditions shall apply exclusively for photos of Soho House Berlin GmbH. All photos upon the homepage of Soho House Berlin GmbH shall be protected by copyright law in accordance with the statutory provisions.

1. All photos are protected by copyright law.

2. Soho House Berlin GmbH permits the depiction, publication and reproduction of these photos in the press as well as in analogous publications exclusively after explicit written agreement.

3. The use of the photos in digital media – also with regards to the type of use defined in Clause 2 – shall require Soho House Berlin GmbH’s prior approval and thus such approval must be requested from Soho House berlin GmbH before any planned publication is made.

4. The use of photos in commercial publishing house products or other publications for resale purposes is not permitted insofar as the use of the photos does not correspond exclusively to the type of use defined in Clause 2.

5. The user himself may not assign the rights conveyed upon him to third parties. He may not disseminate the photos in any form or offer them in online systems for use or distribution.

6. The user shall be obliged to make reference to the author of the photo or the owner of the usage rights (owner: Soho House Berlin GmbH).

7. Immediately after production is completed, the user shall be obliged to send two master copies at its own expense to Soho House Berlin GmbH or inform it of the web site address if it is used on the Internet.

8. Soho House Berlin GmbH reserves the right to revoke the granting of the rights of use owing to an important reason. In this case, the user shall be obliged to make no further depictions, publications or reproductions. Finished products may – provided that they are considered to be appropriate in accordance with this agreement – be resold.

9. In the event of a violation of this agreement, Soho House Berlin GmbH may demand that the user remove all its products with the depiction of the photos at its own expense and either correct them or completely discontinue any such dissemination. Furthermore, in this case, Soho House Berlin GmbH reserves the right to assert damage compensation claims.
